This Privacy Policy describes the information that we, Auran Games Pty Ltd, an Australian corporation ABN 73 081 393 311 (“Auran,” “we,” “us” or “our”) collect from you through the website www.unleashthefury.com and our other web sites relating to the game “Fury,” (collectively, the “Sites”) and through the online service relating to the game “Fury” (the “Service”) and how we use that information. Please note that this Privacy Policy applies solely to our online information-gathering and use practices, and does not apply to any of our offline practices.

By using any of the Sites or the Service, you signify your assent to this Privacy Policy. If you do not agree to this Privacy Policy, please do not use any the Sites or the Service.

1. Information We Collect

1.1 Personal Information
When you use the Sites or the Service, you may be asked to provide certain personal information which can be used to identify you or contact you, such as your name, address, telephone number, email address or instant messaging details (“personal information”).

If you make a purchase or sign-up for a subscription service, you may be asked to provide additional personal information such as your credit card number and details and billing address, though such information is directly collected by and provided to our third party partners (as provided in Section 2.1(b)). We do not receive such billing information or details.
Personal information is typically collected in any of the following circumstances: (i) the online purchase of goods or subscriptions, (ii) registration for online game participation or subscription services, (iii) player match up or other online services, (iv) sweepstakes and contest registrations (and claiming prizes for the same), (v) a consumer complaint or in connection with requests for and provision of support, and/or (vi) surveys or newsletters.

We do not require this personal information be provided to gain access to at least some of the Sites, however, you will not be able to utilize the Service or certain other features that require registration or receive from us materials such as newsletters unless such information is provided.

1.2 Other Information
We may also ask you to provide or collect other information that cannot be used to identify you, such as date or year of birth, age, gender, geographic location, computer capabilities, preferences, IP addresses, browser type and language, access times and referring web site addresses, and information about your visit and game play, such as the pages you view, the links you click and session data. To do this, we may use cookies and other technology (see Section 2.4 below for more detail about the use of such technologies) and we may acquire such non-personal information from third party online tracking service providers. We may combine non-personal information with personal information.

When Fury is updated or "patched," our patch routine may check your computer to see that you have the most recent version of game-specific files. When you log into the Service, your system specifications (such as OS, RAM, video card, monitor, system configuration, etc.) may be reviewed/recorded by us for the purposes of analyzing and optimizing your game experience and in order to provide you with customer service.

1.3 Personal Information of Others

If you recommend Fury to a friend by sending an email to your friend from the “Spread the Word” page, we keep a record of the email address to which you send the recommendation. Where you provide personal information about other individuals to us, we rely on you to inform those individuals that you are providing their personal information to us and advise them we can be contacted in accordance with clause 7 of this Privacy Policy for more information.

2. Use of Information


2.1 Personal information

a. General Uses. The personal information you provide will allow us to complete your registration; fulfill your product or service order; alert you of new products or services, features, or enhancements; handle/route your customer service questions or issues including billing and debt-recovery; and/or notify you of upgrade opportunities, contests, promotions, or special events and offers.

b. Disclosure to Third Parties.
We employ third party vendors to collect personal information on our behalf in connection with the Sites and the Service, and your personal information may be disclosed to third parties that we have engaged to perform services for us in connection with the Service. These third parties are assisting us in providing our services and products to you (including, for example, account management, payment processing and customer support).

Without limiting the foregoing, as mentioned above, Auran does not receive or store any of your credit card or other billing details. When making a purchase via the Sites, your credit card details (if you have provided them) are stored and maintained by a third party vendor who collects such information on our behalf, and who provides such information to our third party billing partner for payment processing. For clarity, if you make any purchase via any other website other than the Sites, the privacy practices of such other website apply and we are not responsible -- this Privacy Policy applies solely to the information collected in or through the Sites or the Service.

We require all our third party vendors and partners to agree that they (a) will not use your personal information for any purpose other than the purpose for which they have been retained, (b) will not share your personal information with anyone other than Auran or our other vendors (except to government authorities, to the extent required by applicable law), and (c) will maintain your personal information in confidence using commercially reasonable security measures consistent with industry practice to protect against the loss, misuse, and alteration of your personal information.

c. Location.
Many of the computer systems on which your personal information is collected, stored and used are owned by third party vendors and are located in Australia, Europe, the United States and elsewhere. Your personal information may be transferred to, used, processed or held by us on systems located in Australia, the United States and in other countries, including countries outside the European Union.

d. Disclosure for Enforcement Purposes.
Your personal information may be disclosed to law enforcement or other appropriate third parties in connection with criminal investigations, investigation of fraud, infringement of intellectual property rights, or other suspected illegal activities, or as otherwise may be required by applicable law, or, as we deem necessary in our sole discretion in order to protect our legal and business interests.

We reserve the right to disclose your personal information as required in special cases when we have reason to believe that disclosing such information is necessary to identify, contact, or bring legal action against you if you are violating the Terms of Use or End User License Agreement (see http://www.unleashthefury.com/legal for Fury and the Service, or may be causing injury to or interference with (intentionally or unintentionally) our rights or property, other users of the Service, or anyone else.

e. Internal Uses.
We may use your personal information for internal marketing, profiling, or demographic purposes, so we can adapt our products and services to better suit your needs.

3. Other Information


We may use any information that is not personal information to generate aggregate statistics about our user community and may provide such information to advertisers and/or our partners. In addition, we may use such information for security, system integrity (the prevention of hacking, cheats, etc.) or enforcement purposes.
 

4. In-Game Posts and Message Boards

You may choose to disclose information about yourself in our online chatrooms or forums, via in-game messaging or instant messaging (or, if you are a paying subscriber, via voice over internet protocol (VoIP) functionality) (collectively, “Forums”), or in creating user “profiles” when you use the Service. Information that you disclose in any Forum or in “profile” information is public information, and there is no expectation of privacy or confidentiality as to such information. Please see our Terms of Use (http://www.unleashthefury.com/legal) on this point and for other guidelines about posting content on the Sites or in or through the Service.

You are solely responsible for the content and accuracy of any profile that you create that may be available to others on our Sites or in or through the Service.

5. Cookies

We use cookies and other technologies to personalize your experience and monitor Site and Service usage. Cookies are small files downloaded to your computer to track movements within web sites. We may link cookie information to personal information.

Most internet browsers will allow you to erase cookies from your computer hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. Please note, however, that if you block cookies, some portions of the Sites or the Service may not function properly

Other technologies we may use from time to time include clear GIFs. Clear GIFs are small graphic images placed on a web page, web-based document, or in an e-mail message and that are invisible to the user because they are very small (often just 1-by-1 pixel) and the same color as the background of the web page, document or e-mail message. We do not use clear GIFs to collect personal information about you. However, we may use clear GIFs to capture statistical usage information for our web pages, features or other elements on a web page. We may correlate this information to a user to personalize user experience and for statistical analysis of user experiences on our web pages.

6. General

6.1 Security

We adopt commercially reasonable security measures consistent with industry practice to assist in protecting against the loss, misuse, and alteration of personal information which is under our control, but no security system can be guaranteed to be 100% secure. As a result, we cannot guarantee the security of our servers, the means by which information is transmitted between your computer and our servers, or any information provided to us or to any third party through or in connection with the Sites or the Service. You provide all such information entirely at your own risk.

6.2 Revisions to Privacy Policy

We reserve the right to update and revise this Privacy Policy at any time. Please check the Privacy Policy each time you use any of the Sites to ensure you are aware of any changes in our practices. You can determine if this Privacy Policy has been revised since your last visit by referring to the "Last Updated" date at the top of this page. All changes to the Privacy Policy will be effective when posted, and your continued use of any Site or the Service after the posting will constitute your acceptance of, and agreement to be bound by, those changes.

6.3 Minors

Persons under age 13 are not permitted to play Fury or use the Service. Except as may be required by law, we will not knowingly collect, maintain, or disclose any personal information from persons under the age of 13.

If you are between the ages of 13 and 18, please have your parent or legal guardian read this Privacy Policy, and get his or her permission before you provide any personal information.
Do not post your real name on a Site, in a Forum or elsewhere in or while using the Service (use screen names), and never tell anyone online anything that could permit them to personally identify or contact you or anyone in your family. If you win a prize in any contest or sweepstakes, before you are entitled to such prize, your parent or legal guardian must send us by mail or fax a signed note at the address or fax number listed in the contest or sweepstakes rules that affirms you were permitted to enter the contest or sweepstakes, and that they will accept the prize on your behalf.

If you are a parent or legal guardian who has discovered that your child has submitted his or her personal information without your permission or consent, you may alert us and request that we close your child’s account. To make such a request, please send a message to the Privacy Policy Administrator at www.auran.com/helpdesk or at the address set out in Section 3.6 below and be sure to include or have available the same user name, password, and email address that your child submitted. We may also ask you for additional information or a written statement in order to confirm that you are the child’s parent or legal guardian, and we may keep a record of all such information provided.

6.4 Business Transfers

We reserve the right to transfer any and all information that you provide, or that we otherwise collect in connection with the Sites or the Service, in connection with a sale or transfer of assets or of any portion of our business.

6.5 Links to Other Sites

Our Sites or the Service may contain links to other websites. This Privacy Policy applies solely to the information which is collected in or through the Sites or the Service. We are not responsible for the privacy practices or content of such other websites, and any link does not constitute any endorsement on our part of any such other websites.

Additionally, there may be unauthorized third party web sites that may be providing links from their sites to our Sites without our knowledge or control. We are not responsible for the content of any third party web sites, expressly disclaim any statements or assertions made on such web sites, and deny all liability associated with your use of, and the content on, such other sites or advertisements contained therein.

6.6 How you may access, change, or delete the information you have provided to us

You have a right to access and update your contact details, billing information and account password online after appropriate authentication of your username and password.

We allow you to control the way that we use personal information that we might obtain, in the following manner. At the time you provide personal information, you have the option of accepting any future offers or information about new products, promotions, or services from us, by opting-in to such offers or information. In addition, many of the "mailings" we may send you, such as newsletters, have procedures within them to cancel the receipt of any future mailings. If at any time you change your mind and do not want to receive e-mails or other correspondence from us or want to have your account deactivated, you may contact our Privacy Policy Administrator at: http://www.auran.com/helpdesk.

If you choose to have your personal information removed from our active databases, we will do so within a reasonable time after your request and we will take reasonable steps to ensure that your personal information is not used (except as may be required by law) by us after your notification to us. Your information may still be retained, however, to resolve potential or actual disputes, enforce our End User License Agreement or Terms of Use (see http://www.unleashthefury.com/legal), and due to technical and legal requirements and constraints related to the security, integrity and operation of our Sites or the Service.

7. Other important agreements that govern your use of our sites and services

In addition to this Privacy Policy, your rights and obligations concerning the Sites and the Service are governed by the Terms of Use and the Fury End User License Agreement (see http://www.unleashthefury.com/legal and http://www.unleashthefury.com/terms.aspx). Please review each of these carefully, as you must agree to be bound by each of them before you may play Fury or use the Service.

8. Information for Persons Outside Australia

By consenting to this Privacy Policy, you confirm that your command and knowledge of English is sufficient to understand the terms and conditions set forth herein.

For persons in European Union countries, as used herein, terms such as "personal information" refer to "personal data" as defined by the Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data. We will not collect any personal data from you unless you provide it voluntarily by providing us with your freely given specific and informed consent. By using the Sites or the Service, you agree that we may transfer your personal information outside the European Union in connection with the purposes stated in this Privacy Policy. Your personal data may be transferred to Australia and/or the United States (and/or other non-EU jurisdictions, as applicable).

Under California law, our customers that are California residents may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not personal information with unaffiliated third parties for direct marketing purposes.

9. Fraud Alert – Phishing and Pop-Ups

One of the latest kinds of Internet fraud is a form of online identity theft known as "phishing." Phishing scam e-mail messages can be difficult to differentiate from a genuine e-mail message from us. Though phishing scams can differ, the paragraph immediately below briefly describes how a typical phishing scam might be carried out.

A phishing scam typically begins when you receive an e-mail message that appears to be from us, with a reasonable request - possibly to verify your personal information or account details. The e-mail message may state a consequence for not responding to such request, including, for instance, suspension or closure of your account. The e-mail message may ask you to respond directly to the message, but more likely you will be asked to clink on a link in the e-mail message -- and when you click on the link, you are taken to a web site that asks you to provide your personal information. While this web site may look authentic, and may even contain links to our Sites, it is in fact a "spoof" site that is set up to steal your personal information.

If you receive such an e-mail message, do not respond, click on any link or otherwise provide any personal information or account details. While we may send you e-mail messages from time to time, we will never send you e-mail messages asking for your personal information or account details. If you suspect that you have received a "phishing" scam email, please forward it to our Privacy Policy Administrator at: http://www.auran.com/helpdesk for investigation and delete the e-mail message upon forwarding.

In addition to phishing, another kind of online identity theft occurs through the use of pop-up windows asking for personal information or account details. We do not use pop-ups on our Sites, and any pop-ups are not from us. You should not provide any information through any pop-ups.
